1. Overview of Runway Junkie Privacy Policy

Thank you for visiting Runway Junkie's website located at http://www.RunwayJunkie.com  (hereinafter “Runway Junkie,” “us,” or “we”). Runway Junkie respects the privacy of the visitors to the Runway Junkie website (“Website” or “Site”).  This Privacy Policy is an agreement between Runway Junkie and you, as the user of the Runway Junkie Website.  It applies to the services available under the domain and sub domains of http://www.RunwayJunkie.com.  This agreement tells you when this policy is effective, what information we collect from you, how we might use it, how we may change this policy, and the steps we take to ensure that your personal information is protected.

Changes to this Privacy Policy are discussed at the end of the document.  Each time you access the Website, however, the current version of the Privacy Policy applies.  Accordingly, each time you access the Website, check the date of this Privacy Policy and review any changes since the last time you used the site.

2. Agreement to Terms

By using our Website, you agree (i) that you have read and understand the Runway Junkie Privacy Policy, which describes how we use your personal information and what options you have to update or request deletion of information you give us, and (ii) that you consent to the collection and use of personal information you provide us.  

All activities in which you may engage on this Website are voluntary. You are not required to provide any personal information to us unless you choose to access features on this Site, which require the information.  If you do not agree with the terms of this policy, then you should immediately exit this Website and discontinue using the Site.

This Privacy Policy is also incorporated into and subject to the terms of the Runway Junkie End User Agreement.  By accepting the Privacy Policy and the End User Agreement when registering, you therefore, also expressly consent to the terms of this privacy policy as well as to our terms of use.  

3. Use of Website Restricted to United States Residents

The Website is hosted on servers located in the United States of America and is intended for use by United States residents.  You may not use this service if you are not a United States resident.

4. Gathering and Use of Personal Information

In general, you can browse the Site without telling us who you are or revealing any personal information about yourself.  Once you give us your personal information, however, you are not anonymous to us.  

Our primary purpose in collecting personal information is to provide you with a safe, efficient, and customized experience.  We only collect personal information about you that we consider necessary for achieving this purpose.  If you choose to use our services, we may require you to provide contact and identity information, billing information, shipping information, and other personal information as indicated on the forms throughout the Site.  We indicate which fields are required and which fields are optional.  If you do not provide the requested personal information, you may not be able to use the features of the Site where such information is requested.  Runway Junkie considers your personal information as an asset that must be protected.  Therefore, any personal information you give us is stored in a secure environment.

As explained in section 3.5 of our End User Agreement, monetary transactions between Buyers and Sellers does not occur on this Site.  All monetary transactions take place on Foxycart.com.

Buyers and Sellers are, however, encouraged to maintain valid PayPal and GoogleCheckout accounts.  We do not store this information on file since it is communicated between the buyer and seller privately.  

Despite our best efforts to keep your personal information safe, we cannot promise or guarantee that a third-party will not unlawfully intercept or access transmissions containing such information.  You agree to not hold Runway Junkie liable for the abuse or misuse of your personal information gained without our knowledge or permission.

5. Gathering and Use of General Information

In addition to collecting certain personal information, we may collect more general information.  We use cookies to collect this information in order to provide you with more streamlined ordering and other useful features.  A cookie is a string of information that a website stores on a user’s computer, and that the user’s browser provides to the website each time the user submits a query to the Site.  Runway Junkie uses web cookies to track the pages that users visit during each Website session, both to help us improve users’ experiences and to help us understand how the Website is being used.

Users who do not want web cookies placed on their computers should set their browsers to refuse cookies before accessing the Website, with the understanding that certain features of the Website may not function properly without the aid of cookies.  Website users who refuse web cookies assume all responsibility for any resulting loss of functionality.

We also use a tool called Google Analytics. 6. Information Pertaining to Children and Minors

Runway Junkie does not want to collect personal information from children (persons under the age of 18).  Children are not eligible to use the Site unsupervised and we ask that children do not submit any personal information to us.  If you are under the age of 18, you may only use this Site in conjunction with and under the supervision of your parents or guardians.  If we become aware that a child is attempting to or has submitted personal information via this Site, we will notify the user that we may not accept his or her personal information.  We will then delete any such personal information from our records.

7. Disclosure of Information

Except as otherwise described in this Policy, we do not sell or rent any of your personal information to third parties for their marketing purposes without your explicit consent.  We may, however, share your information for the purposes of providing services to you or as indicated below:

I. In response to a subpoena, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.

II. When disclosure is appropriate in connection with efforts to investigate, prevent or take other action regarding illegal activity, suspected fraud or other wrongdoing.

III. In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the event of bankruptcy.

IV. With third parties or corporate affiliates, which are required by contract to comply with this Privacy Policy, so that such third parties may assist in providing services to you or carrying out transactions you request.

8. Use of Other Users’ Information

Engaging in transactions on this Site involves the sharing of personal information with parties other than Runway Junkie.  We encourage you to disclose your privacy practices and respect the privacy of other users.  We cannot guarantee the privacy or security of information you choose to share with other users and therefore we encourage you to evaluate the policies of a trading partner before entering into a transaction and choosing to share your information.  You agree to not hold Runway Junkie for any use or misuse of your personal information obtained from you via this Site from any transaction, including, but not limited to making a purchase or sale, leaving a comment, or posting a blog.

You agree to use user information you obtain via this Site only for:  (i) Runway Junkie transaction-related purposes that are not unsolicited commercial messages; (ii) using services offered through Runway Junkie; or (iii) other purposes that a user expressly chooses.

9. Control of Your Password

As set forth in section 3.4 of the End User’s Agreement and incorporated into this Privacy Policy by reference, you are responsible for maintaining confidentiality of your password and are solely responsible for all activity, liability and damage resulting from its use, whether authorized or unauthorized.  

10. California Privacy Rights

11. Request of or Change of Information

12. Effective Date of and Changes to Privacy Policy

This privacy policy is effective upon acceptance in registration for new registering users, and is otherwise effective on August 31, 2010 for all users.  We reserve the right to change this Privacy Policy at any time.  Except as expressly set forth elsewhere in this Policy, all changes take effect as soon as they are posted.  Each time you use this Website, the current version of this Privacy Policy applies. 

We will conspicuously post any material changes to this Policy at least fifteen (15) days prior to the changes taking effect.  After the changes take effect, all current and new information will be subject to the terms of the revised Policy.  We encourage you to review this privacy policy regularly for any changes.  

Your continued use of the Site after we post any such modifications will constitute your acknowledgement of the modified policy and your agreement to abide and be bound by the modified policy.  This applies to both material and immaterial changes to this Policy.
